Perhaps you're unaware that he is now in the terminal phase of a cancer (so
I've heard), so by the time the FCC and USAtty could prosecute him, he'd be
dead anyway.... There exists no disincentive to keep him off the air.

Warning Notice: Unlicensed Radio Operation
Dear Mr. Burton:
Monitoring information before the Commission indicates that on numerous
occasions since January 2003, you have operated radio transmitting equipment on
the Two Meter Amateur band in the Los Angeles area. We note that you were
convicted in 1984, 1990, 1993 and 2000 of unlicensed radio operation under
Section 301 of the Communications Act of 1934, as amended, and have served
several prison terms.
You are advised that additional instances of unlicensed operation, on any
frequency for which a license is required, will lead to the same result.
Our records indicate that you have an application under review for a license in
the General Mobile Radio Service. Issues surrounding the 2003 unlicensed radio
operation will be made a part of that proceeding.
