Whoever said the FCC was an "expert agency"???


I realize that may seem strange to anyone who hasn't been around
radio regulation for as long as a few decades, but the FCC is indeed,
as the final authority, *the* expert agency. And have often been so
considered by various courts when faced with challenges to some of
their actions.

Yes they are the final authority but that does not make them an "expert".
Even a court ruling does not make you an expert. In addition, the courts
are ruling on the legality of the action not necessarily whether the action
is correct in an engineering or technical sense.

I think you missed the point, Dee. FCC is the expert agency simply
because they are the final authority, or the final authority has
deferred to tnem as the expert agency. Nobody said they're right. See
N2EY's recent post on the subject.
